These Terms of Service govern your use of the Elevated Inkness website. Please read them carefully. By using this site, you agree to these terms. If you do not agree, please discontinue use.
1. Acceptance of Terms
By accessing or using the Elevated Inkness website, you agree to these Terms of Service. If you do not agree, do not use this website. These terms apply to all visitors, users, and others who access or use the site.
2. Services and Eligibility
This website provides information about custom tattoo services offered by Elevated Inkness. Tattoo services are performed exclusively at our licensed Florida tattoo establishment. Use of this website does not guarantee appointment availability. You must be at least 18 years old to book a tattoo appointment. Minors aged 16–17 may receive tattoos only with a parent or legal guardian present, valid government-issued photo identification from both parties, and a written notarized consent form on the Florida Department of Health prescribed format. We do not tattoo anyone under 16 except as permitted by Florida law for medical or dental purposes.
3. Electronic Signatures and Records
You consent to conduct transactions electronically and agree that electronic signatures and records are legally binding under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law. When you submit a waiver, intake form, or any consent through this website, you acknowledge that your electronic submission constitutes your legally binding signature and agreement.
4. Booking, Deposits, and Cancellations
Appointments are booked by phone at (352) 617-9836. Deposits are required to reserve appointment time and are applied to the final tattoo price. Deposits are non-refundable but may be transferable once with at least 48 hours notice, at the artist's discretion. No-shows and cancellations with less than 48 hours notice forfeit the deposit. Rescheduling is subject to availability. Payment for services is due at the time of the appointment.
5. Assumption of Risk and Waiver
Tattooing is a permanent body modification that carries inherent risks including but not limited to infection, allergic reaction, scarring, keloid formation, MRI complications, and dissatisfaction with the result. By submitting our waiver form, you acknowledge that you have been informed of these risks and voluntarily assume them. All clients must complete a waiver before any tattoo procedure. The waiver is a legally binding release of liability to the fullest extent permitted by Florida law.
6. Intellectual Property
All content on this website — including text, images, logos, designs, and tattoo portfolio photographs — is the property of Elevated Inkness or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works of any site content without prior written permission. Tattoo designs created by our artist remain the intellectual property of the artist unless otherwise agreed in writing.
7. Prohibited Conduct
You agree not to misuse this website. Prohibited conduct includes attempting to book services in violation of Florida law, misrepresenting your age or identity, submitting false information, uploading harmful or infringing content, interfering with site security or operation, using the site for any unlawful purpose, and harassing or abusive communication with our staff.
8. Third-Party Links and Services
This website may contain links to third-party websites or services not owned or controlled by Elevated Inkness. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that Elevated Inkness is not liable for any damage or loss caused by use of any third-party content or services.
9. Disclaimer of Warranties
This website and all information, content, and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by Florida law, Elevated Inkness and its owners, artists, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Our total liability for any claim arising from use of this website is limited to the amount you paid us, if any, for use of the site.
11. Indemnification
You agree to indemnify, defend, and hold harmless Elevated Inkness and its owners, artists, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of this website, your violation of these Terms of Service, or your violation of any third-party rights.
12. Compliance with Florida Tattoo Law
Elevated Inkness operates in compliance with Florida Statutes § 381.00777 and Florida Administrative Code Rule 64E-28.005. Tattoo services are performed only at our licensed Florida tattoo establishment. We follow all Florida Department of Health requirements for licensure, sterilization, single-use equipment, age verification, minor consent, and record-keeping. Nothing in these Terms of Service is intended to override or waive any statutory or regulatory requirement.
13. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these terms or your use of this website shall be resolved exclusively in the state or federal courts located in Alachua County, Florida. You agree to submit to the personal jurisdiction of those courts.
14. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes become effective upon posting to this page. Your continued use of the website after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically. The date of last update is stated at the bottom of this page.
